Privacy Policy

We process only what we need in order to deal with your enquiry. We do not sell your details to anyone and we do not transfer them outside the European Union.

Who the controller is

The controller of personal data is HMG Invest development group s.r.o., registered office at U nových vil 170/18, Strašnice, 100 00 Praha 10, Czech Republic, company ID 21307318, registered in the Commercial Register kept by the Municipal Court in Prague, section C, insert 399390.

We have not appointed a data protection officer. We do not meet any of the conditions under which the GDPR requires one — we are not a public authority, we do not process personal data on a large scale or systematically, and we do not process special categories of data.

What data we process

From the enquiry form we process only what you enter yourself:

  • your name
  • your email address
  • your phone number, if you give one
  • the address of the property, if you give one
  • the text of your message and any file you attach

Operational data

Our server records technical access data — IP address, time of request, browser type and the page requested. This serves solely to keep the site running and secure, in particular to defend against automated abuse of the form.

We measure traffic with a tool that stores no cookies or other identifiers on your device and builds no profiles of individual visitors. The data stays on our own server and is not passed to any third party.

Why and on what basis we process the data

Where your enquiry is directed towards entering into a contract, we process the data under Article 6(1)(b) GDPR — steps taken at your request prior to entering into a contract.

Where it is a general question with no intention of entering into a contract, we rely on Article 6(1)(f) GDPR, our legitimate interest. That interest lies in being able to answer the question and communicate with someone interested in our services.

Operational data and protection against abuse of the form are likewise processed under Article 6(1)(f) GDPR — specifically the interest in running the site securely and reliably.

We do not ask for your consent and the form contains no consent tick box. It would be unnecessary and legally weaker.

How long we keep the data

  • An enquiry that does not lead to a contract: 6 months from the last communication.
  • An enquiry that leads to a contract: for the term of the contract and then for the limitation period, normally 3 years.
  • Accounting and tax records: for the period required by law, normally 10 years.
  • Server logs: 6 months.

Who we share the data with

We do not pass personal data to anyone who does not need it in order to deal with your enquiry. The following may have access:

  • the provider of the server space the site runs on
  • the provider of the mailbox the enquiry arrives in
  • an external accountant and tax adviser, if a contract is concluded
  • a solicitor, should we need to pursue or defend a legal claim

Transfers outside the European Union

We do not transfer personal data to countries outside the European Union or to international organisations. The site runs on a server located in the European Union, the mailbox is operated in the Czech Republic, and we run our own traffic measurement.

Your rights

In connection with the processing of personal data you have the following rights:

  • the right of access to the data we hold about you
  • the right to have inaccurate or incomplete data corrected
  • the right to erasure where the reason for processing has fallen away
  • the right to restriction of processing
  • the right to data portability
  • the right to lodge a complaint with the supervisory authority

Right to object

Where we process your data on the basis of legitimate interest, you have the right to object to that processing at any time. Simply write to info@hmginvest.cz. On receiving an objection we will stop processing unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms.

Supervisory authority

You have the right to lodge a complaint with the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Prague 7, www.uoou.gov.cz. We would be glad if you came to us first — most things can be sorted out faster directly.

Voluntary provision and automated decision-making

Filling in the form is entirely voluntary. Without a name, an email address and a description of the enquiry, however, we cannot deal with it.

We do not carry out automated decision-making or profiling that would produce legal effects for you or similarly significantly affect you.
